To enter the giveaway you must adhere to all aspects detailed on the tag of your Loch Ness by Jacobite Jess plush toy. 2. The closing time for entries will be 23:59pm 10 April 2018. After this time, no further entries to the giveaway will be accepted. 3. Please note that Loch Ness by Jacobite may contact you to discuss your entry to the giveaway. Any personal data which we collect from you, or that you provide to us, will be processed by us in accordance with the Privacy Policy set out at the end of these Terms. Please read this policy carefully to understand our views and practices regarding your personal data and how we will treat it. RESTRICTIONS ON ENTRY 1. Entry is open to all adults aged 18 or over except: · Loch Ness by Jacobite’s employees and their immediate families (such as children, parents, spouses, siblings, aunts, uncles and grandparents); or · Employees, officers or agents of any companies associated with the Giveaway. 2. No more than one entry may be made per person. 3. Entries may be disqualified if: · they are made on the basis of a false name or other false entry details; · they involve an attempt to tamper or interfere with the entry process; · they are made using results generated by a script, macro or the use of an automated device; or · Loch Ness by Jacobite otherwise believes that they have been made in breach of these Terms or the spirit of the Giveaway. 4. The prize must be taken by 31 May 2018. RIGHTS IN ENTRIES 1. In consideration of Loch Ness by Jacobite running the Giveaway you grant us a worldwide, irrevocable, royalty free, perpetual licence to feature your entry in Loch Ness by Jacobite’s leaflets and marketing materials, on the Loch Ness by Jacobite website and on social media channels. Such use is subject to these Terms and the Privacy Policy set out at the end of these Terms. PRIZES 1. There will be one prize for one Instagram entry winner. The winner from Instagram will win one family ticket (two adults and two children) for the Rebellion cruise, return train fayre to a Scottish train station and an overnight stay at the Heathmount hotel in Inverness. 2. After the closing date the giveaway winner shall be selected at random. 3. The prize is valid until 31.05.18 subject to availability. Booking must be made in advance. We recommend booking at least one week ahead to ensure availability. CONTACTING THE WINNERS AND DISTRIBUTING THE PRIZES 1. Loch Ness by Jacobite reserves the right to re-draw the Giveaway if a Giveaway winner: · cannot reasonably be contacted by Loch Ness by Jacobite within 7 days of the date on which they are selected; or · does not provide Loch Ness by Jacobite with any information and/or confirmations requested to prove their eligibility to enter the Giveaway. 4. No cash alternative is available to the prize and it cannot be transferred, sold or exchanged. PUBLICITY AND PRIVACY 1. The names and countries of residence of the Giveaway winners will be authorised to be announced on Loch Ness by Jacobite’s Instagram page within 28 days of the winners being selected. 2. Giveaway winners may be asked to take part in free publicity surrounding their win but participation in such publicity is not compulsory. 3. Any personal data which we collect from you, or that you provide to us, will be processed by us in accordance with the Privacy Policy set out at the end of these Terms. If Loch Ness by Jacobite fails to comply with these Terms it will be responsible for the loss or damage which you suffer which is a foreseeable result of its breach of the Terms or its negligence. However, Loch Ness by Jacobite will not be responsible for loss or damage which is not foreseeable or which is outside of Loch Ness by Jacobite’s reasonable control. 2. No responsibility or liability will be accepted by Loch Ness by Jacobite for entries which are not received or are lost in transmission for any reason. Proof of sending or transmission will not be accepted as proof of entry. Corrupted, damaged, unintelligible, inaudible or incomplete entries will be invalid. SOCIAL MEDIA SITES By accepting these Terms you acknowledge that: 1. the Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram (the Social Media Site(s)); 2. the Social Media Site(s)’ operators have no liability to you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Giveaway for any loss of profits, loss of sales or business, loss of agreements or contracts, loss of anticipated savings, loss of or damage to goodwill, loss of use or corruption of software, data or information or any other direct, indirect or consequential loss; and 3. any use of the Social Media Site(s) in relation to the Giveaway will be subject to the Terms of Service / Use and Privacy Policies shown on those site(s) from time to time.

GENERAL 1. Discretion: Where these Terms refer to the exercise of any discretion by Loch Ness by Jacobite or its appointed judges such discretion shall be absolute and no correspondence shall be entered into regarding any associated decisions. 2. Other promotions: Any other promotions run by Loch Ness by Jacobite will be governed by their own separate terms and conditions. 3. General Terms: In addition to these Terms, your use of Loch Ness by Jacobite websites shall also be subject to any Terms of Use or Privacy Policies shown on those websites from time to time. 4. Events beyond our control: Events may occur that render the Giveaway itself, the selection of winners or the awarding of prizes impractical due to reasons beyond Loch Ness by Jacobite’s control. We may, at our discretion, make such variations or amendments to the Giveaway as we feel are necessary as a result of such events. 5. Cancellation of the Giveaway: While Loch Ness by Jacobite will use every effort to ensure the Giveaway is open until the intended closing date we reserve the right to cancel, terminate, modify or suspend the Giveaway in whole or in part at anytime. If you have already entered the Giveaway by that point we will notify you of the change via the email address which you supply to us when you enter the Giveaway. We will endeavour to give 2 days' notice of such a cancellation, termination, modification or suspension. If this is not possible we shall give you as much notice as we reasonably can. 6. Entire Agreement: These Terms (together with the documents referred to in them) constitute the entire agreement between you and Loch Ness by Jacobite in relation to your entry to the Giveaway, and supersede and extinguish all previous agreements in respect of the Giveaway. 7. Variation: We may update these Terms from time to time. We will notify you of any changes either by e-mail or by placing a suitable notice on the Site. These changes will take effect once such notice has been given. 8. Assignment: Loch Ness by Jacobite may at any time assign, transfer, mortgage, charge or deal in any other manner with any or all of its rights and obligations under or arising from these Terms. 9. Severability: Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 10. 3rd Party Rights: These Terms relate to an agreement between you and Loch Ness by Jacobite. No other person shall have any rights to enforce any of these Terms. 11. Applicable Law: These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Scottish law. The parties irrevocably agree that the courts of Scotland shall have non-exclusive jurisdiction to settle any such dispute or claim. PRIVACY POLICY 1.
